Completed the sale of my flat in Walthamstow last September yet the purchaser is e-mailing me to moan that his lawyer is waiting to hear from mine. What should my lawyer have done now that I have sold?
Post completion of your house sale your lawyer should send the transfer documentation and all of the paperwork to the purchaser's lawyers. If applicable, your lawyer must also send confirmation that the home loan has been discharged to the purchasers solicitors. There are no post completion requirements unique to conveyancing in Walthamstow.
I own a 4 bedroom Victorian house in Walthamstow. Conveyancing lawyer represented me and Bank of Scotland. I happened to do a free search for it on the Land Registry database and I saw a couple of entries: one for freehold, the second leasehold under the matching property. If a house is not a freehold shouldn't I have been informed?
You should review the Freehold register you have again and check the Charges Register for mention of a lease. The best way to be sure that you are also the registered proprietor of the leasehold and freehold title as well is to check (£3). It is not completely unheard of in Walthamstow and other areas of the country and poses no real issues for owners other than when they buy they have to account for both freehold and leasehold interests when dealing with purchasers. You can also question the position with your conveyancing practitioner who carried out the work.
I am buying my first flat in Walthamstow with the aid of help to buy. The builders refused to move on the price so I negotiated five thousand pounds worth of extras instead. The house builders rep suggested that I not to tell my solicitor about the deal as it could jeopardize my mortgage with the bank. Should I keep quiet?.
All lenders require a Disclosure of Incentives Form from the builder of any new build, converted or renovated property, It is available online from the Lenders’ Handbook page on the CML website. CML form is completed and handed to the lender's surveyor when the inspection is done.
Lenders have different policies on incentives. Some accept none at all, cash or physical, while others will accept cash incentives up to 5%.
Hard to understand why the representative of a builder would be suggesting you withold information from a solicitor when all this will be clearly visible on forms the builder has to supply to its solicitor, the buyer's solicitor and the surveyor.
Am I better off to appoint a Walthamstow conveyancing lawyer based in the location that I am buying? An old friend can execute the legal work however his firm is located 300miles drive away.
The benefit of a local Walthamstow conveyancing firm is that you can attend the office to sign paperwork, deliver your identification documents and pester them where appropriate. Having local Walthamstow know how is a bonus. That being said it's more important to get someone that will do a good and efficient job. If you know people who instructed your friend and on the whole were happy that must surpass using an unknown Walthamstow conveyancing lawyer solely due to them being local.
Our financial adviser has suggested using their solicitor for my conveyancing in Walthamstow - won’t it be better to just instruct them?
It is not always the case and you are free to use whichever solicitor you prefer for your Walthamstow conveyancing. A lawyer recommended by an estate agent may not necessarily be the right solicitor, they may put forward their own conveyancing firm who are based far away. In this instance you may not have contact with your solicitor and due to the lack of continuity in the transaction, it may be difficult to obtain progress reports.
