I am considering refinancing my apartment in Coxhoe, does my lawyer need to be on the Bank of Ireland Solicitor panel?

There is nothing to stop you using your solicitor, but Bank of Ireland will insist on their interests being represented by a firm on their conveyancing panel. There is greater potential for delays and confusion with an additional lawyer added to the mix, and it will undoubtedly be more expensive too.

Have just purchased a repossessed house at auction in Coxhoe. Conveyancing is necessary. What happens now?

Now that you are exchanged you will need to find a conveyancing solicitor as a matter of urgency as you now have a pending deadline in which to complete the transaction. Every auction property should have a corresponding legal pack. This will include evidence of title and search results. If you have purchased leasehold premises the auction papers should contain a copy of the lease, management information and a sellers leasehold information form and associated conveyancing paperwork pertinent to a leasehold property. You must pass this on to the conveyancer instructed by you ASAP. You also need to ensure that your finances are in place to complete the transaction on the set completion date.

We have agreed to purchase a house in Coxhoe. A rare aspect is that the roof has a solar panel. Skipton have issued a mortgage offer so presumably this is not a concern to them. Why is my solicitor raising questions about the panel?

Given that your lender is Skipton your lawyer must follow the conveyancing requirements contained in Part 2 of UK Finance Lenders’ Handbook for Skipton. The Council of Mortgage Lenders’ Handbook stipulates minimum provisions for solar panel roof-space leases, and solicitors are required to report to Skipton where a lease does not comply with these requirements. The requirements relate to the installation of panels on properties nationwide and is not isolated to Coxhoe.

Skipton have agreed my mortgage in principle, my offer on a house in Coxhoe has been accepted, what are the next steps?

Your property agent will wish to be informed of your solicitor's details (make sure the conveyancers are on the bank’s approved list). Call up Skipton or your broker and finalise any appropriate paperwork. Skipton will appoint a valuer who will get in touch with the estate agent or seller to arrange an appointment. Once conducted (assuming no problems) it takes on average a fortnight to receive the mortgage offer. Skipton will issue the offer to you and your lawyers. The legal work will then take it’s course according the nature and complexity of the conveyancing in Coxhoe.

The deeds to my home can not be found. The conveyancers who handled the conveyancing in Coxhoe 4 years ago no longer exist. What are my options?

Assuming the title is registered the details of your ownership will be recorded by HMLR with a Title Number. It is possible to execute a search at the Land Registry, find your property and order up to date copies of the property title for less than a fiver. Where the property is Leasehold then the Land Registry will also normally retain a file duplicate of the Registered Lease and again, a copy can be ordered for twenty pounds.

I'm refinancing my existing house to a BTL loan with The Mortgage Works and I will use the ballance of the raised equity towards another house. The location we are interested in is Coxhoe. Will your lawyers be able to act for both sets of lenders and link together the transactions?

Myself and my partner have just had an offer agreed on a apartment and had meeting on Monday with Leeds Building Society for the mortgage. They advised us that when it comes to choosing a conveyancing practitioner that if they are not on their approved panel of solicitors then we will be subject to an an extra charge of £200. This is because they will then have to appoint a property lawyer to act on their behalf as well as the one we select for ourselves and we are liable for their invoice. I have asked Leeds Building Society to supply me with a list so I can seek estimates only from their approved solicitors but was told they dont have such a list to hand over. Is there a simple way of finding out who is on a lender panel?

Ask Leeds Building Society what their criteria for joining their panel is for a solicitor. Then ask the conveyancing practitioner of your choice whether they meet the criteria and have they acted on mortgages for Leeds Building Society in the past. If the answer to those is yes, then just clarify this with Leeds Building Society. Alternatively please make use of our search tool and we may be able to find you a property lawyer in Coxhoe on the panel for Leeds Building Society.
