My fiance and I intend to remortgage our penthouse in Worplesdon with RBS. We have a son approaching twenty who lives with us. Our solicitor requested us to identify anyone over the age of 17 other than ourselves who lives in the flat. Our lawyer has now e-mailed a document for our son to sign, waiving any legal rights in the event that the property is forfeited by the lender. I have two concerns (1) Is this document specific to the RBS conveyancing panel as he never had to sign this form when we bought 3 years ago (2) Does our son by signing this compromise his entitlement to inherit the property?

On the face of it your lawyer has done nothing wrong as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to RBS. This is solely used to protect RBS if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave. It does not impact your son’s right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of RBS had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.

This question may be naive but I am new to the home moving as FTB of a garden flat in Worplesdon. Do I receive the keys to the property on completion from my lawyer? If this is the case, I will appoint a High Street conveyancing solicitor in Worplesdon?

On the day of completion you do not need to go to the conveyancers office in Worplesdon. Conveyancing lawyers for you will transfer the completion advance to the seller's conveyancers, and once they have received this, you should be able to receive the keys from the selling Agents and start moving into the property. Usually this happens early afternoon.

Can you help - my lawyer advises that missing deeds insurance is needed on my purchase. What is the typical level of cover needed for conveyancing in Worplesdon?

The appropriate level of missing deeds indemnity insurance depends on who your lender is. It would differ for example between HSBC Bank and Norwich and Peterborough Building Society. Conveyancing solicitors as opposed to borrowers take out such policies.

I am buying a property in Worplesdon. One unusual aspect is that the roof has a solar panel. Aldermore have issued a mortgage offer so presumably this is not a concern to them. Why is my solicitor raising questions about the panel?

As your lender is Aldermore your lawyer must comply with the conveyancing instructions outlined in Section two of UK Finance Lenders’ Handbook for Aldermore. The Council of Mortgage Lenders’ Handbook contains minimum provisions for solar panel roof-space leases, and property lawyers are required to report to Aldermore where a lease fails to satisfy these specifications. The requirements relate to the installation of panels on properties countrywide and is not limited to Worplesdon.

I'm converting the mortgage on my existing house to a BTL mortgage with Skipton Building Society and intend to use the remaining equity as a deposit on a second property. Do use our comparison tool on this site to be sure that the conveyancers are on the relevant lender panels. Assuming that they are the conveyancer will be able to connect the two transactions but you should have a chat with you solicitor and make clear your expectations and needs.
