We know of a number of auction lawyers we can put you in touch with those conducting auction conveyancing. Horsham is one of the many locations in which our lawyers are based.

I am due to move house in March. Will my conveyancing solicitor communicate with the removal company on the completion day. As an aside, can you put forward a removal company in Horsham. Conveyancing firm was chosen prior to coming across this site.

On the afternoon of completion you can collect the keys from your property agent however this should only occur after the previous owners conveyancers advise the agent that the monies to complete are in and the keys can be given over. Subsequently you will need to advise the removal men that you are ready to move in. We are not in a position to recommend a particular removal organisation but can assist you in locating a residential property solicitor in Horsham or a lawyer that specialises in conveyancing in Horsham.

I have paid off my mortgage with Yorkshire BS. I assume I don't need a Horsham lawyer on the Yorkshire BS panel to remove the mortgage at the Land Registry. Please confirm.

If you have finished paying off your Yorkshire BS mortgage, they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Yorkshire BS mortgage from the register. Yorkshire BS, and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:

  1. but are not moving to another property
  2. where Yorkshire BS has sent the Land Registry the discharge electronically, and
  3. Yorkshire BS has instructed the Land Registry to do so
The Land Registry will send you a letter confirming that your Yorkshire BS mortgage has been paid off.

I have decided to exercise my right to buy my property in Horsham off the council. I have a mortgage offer with Yorkshire BS. Conveyancing is new to me. Can I proceed without a solicitor easily? I think we can but we keep being told I should use one. Any advice?

It is not advisable to proceed with a house purchase without a solicitor. The council's solicitor are not acting for you. You need a solicitor for a number reasons. One of which is to verify what plans the Council have for repairs and refurbishment for the next five years. Many leaseholders have been stung for contributions of thousands of pounds. In any event, if you are getting a mortgage with Yorkshire BS, you will need to appoint a solicitor on the Yorkshire BS conveyancing panel.

Will my conveyancer be raising enquiries about flooding as part of the conveyancing in Horsham.

Flooding is a growing risk for conveyancers carrying out conveyancing in Horsham. There are those who buy a property in Horsham, completely aware that at some time, it may suffer from flooding. However, aside from the physical damage, where a property is at risk of flooding, it may be difficult to obtain a mortgage, satisfactory building insurance, or dispose of the premises. Steps can be carried out as part of the conveyancing process to forewarn the purchaser.

Solicitors are not best placed to offer advice on flood risk, but there are a number of searches that may be carried out by the purchaser or by their lawyers which can give them a better appreciation of the risks in Horsham. The standard information sent to a buyer’s conveyancer (where the solicitors are adopting what is known as the Conveyancing Protocol) contains a usual question of the vendor to find out whether the property has suffered from flooding. In the event that the residence has been flooded in past which is not disclosed by the vendor, then a purchaser may bring a legal claim for losses as a result of such an incorrect response. A purchaser’s solicitors should also carry out an enviro report. This should disclose if there is any known flood risk. If so, additional investigations will need to be made.

I purchased a renovated Georgian property in Horsham. Conveyancing practitioner represented me and Yorkshire Building Society. I did a free Land Registry search last week and I saw two entries: one for freehold, the second leasehold with the matching address. If a house is not a freehold shouldn't I have been informed?

You need to assess the Freehold register you have again and check the Charges Register for mention of a lease. The best way to be sure that you are also the registered owner of the leasehold and freehold title as well is to check (£3). It is not completely unheard of in Horsham and other areas of the country and poses no real issues for owners other than when they buy they have to account for both freehold and leasehold interests when dealing with mortgage companies. You can also question the position with your conveyancing lawyer who conducted the purchase.

How does conveyancing in Horsham differ for newly converted properties?

Most buyers of new build residence in Horsham come to us having been asked by the housebuilder to exchange contracts and commit to the purchase even before the property is ready to move into. This is because developers in Horsham typically buy the site, plan the estate and want to get the plots sold off as they are building the properties. Buyers, therefore, will have to exchange contracts without actually seeing the house they are buying. To reduce the chances of losing the property, buyers should instruct conveyancers as soon as the property is reserved and mortgage applications should be submitted quickly. Due to the fact that it could be several months and even years between exchange of contracts and completion, the mortgage offer may need to be extended. It would be wise to use a lawyer who specialises in new build conveyancing especially if they are accustomed to new build conveyancing in Horsham or who has acted in the same development.
