I am assisting my mother sell her property in Cleator Moor. Will the solicitor arrange an energy assessment or do I organise this?
Following the abolition of Home Packs, energy assessments became a required part of selling a house. An EPC should be commissioned in advance of the property being put on the market. This is not something that lawyers normally arrange. If you are using a Cleator Moor conveyancing solicitor they might be able to arrange EPC’s due to their contacts with long established Cleator Moor assessors
I have paid off my mortgage with Nationwide. I assume I don't need a Cleator Moor property lawyer on the Nationwide panel to remove the mortgage at the Land Registry. Please confirm.
If you have finished paying off your Nationwide mortgage, they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Nationwide mortgage from the register. Nationwide, and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:
- but are not moving to another property
- where Nationwide has sent the Land Registry the discharge electronically, and
- Nationwide has instructed the Land Registry to do so
I have decided to exercise my right to buy my property in Cleator Moor off the council. I have a mortgage offer with UBS. Conveyancing is new to me. Can I proceed without a solicitor easily? I think we can but we keep being told I should have one. Any advice?
It is not advisable to proceed with a house purchase without a solicitor. The council's solicitor are not acting for you. You need a solicitor for a number reasons. One of which is to verify what plans the Council have for repairs and refurbishment for the next five years. Many leaseholders have been stung for contributions of thousands of pounds. In any event, if you are getting a mortgage with UBS, you will need to appoint a solicitor on the UBS conveyancing panel.
Over the last few months I have been searching for a leasehold apartment up to £195,000 and found one near me in Cleator Moor I like with a park and station nearby, however it only has 61 remaining years left on the lease. There is not much else in Cleator Moor for this price, so just wondered if I would be making a mistake buying a lease with such few years left?
Should you need a mortgage the shortness of the lease will be a potential deal breaker. Reduce the price by the expected lease extension will cost if not already taken into account. If the current owner has owned the property for a minimum of 2 years you can ask them to commence the lease extension formalities and then assign it to you. You can add 90 years to the current lease and have £0 ground rent by law. You should speak to your conveyancing lawyer regarding this matter.
I own a leasehold flat in Cleator Moor. Conveyancing and The Mortgage Works mortgage went though with no issue. I have received a letter from someone saying they have taken over the reversionary interest in the property. Attached was a ground rent demand for rent dating back to 1993. The conveyancing solicitor in Cleator Moor who previously acted has long since retired. What should I do?
The first thing you should do is make enquiries of the Land Registry to make sure that this person is indeed the new freeholder. There is no need to incur the fees of a Cleator Moor conveyancing solicitor to do this as you can do this on the Land Registry website for £3. You should note that in any event, even if this is the legitimate freeholder, under the Limitation Act 1980 the limitation period for recovery of ground rent is six years.

How much is the ground rent and service charge? The best form of lease arrangement is a share of the freehold. In this arrangement the lessees enjoy control and even though a managing agent is usually employed if it is bigger than a house conversion, the managing agent is directed by the tenants. Please note that where the lease has less than eighty years it will affect the value of the apartment. It is worth checking with your mortgage company that they are willing to to proceed given the lease term. A short lease means that you will most likely need a lease extension at some point and you need to have some idea of how much this would cost. For most Cleator Moorlease extensions you would need to own the residence for two years in order to be entitled to extend the lease.
