I am acquiring a house for cash in Iver. I have been residing for the previous dozen years in Iver. Conveyancing searches are a lot of money. As I know the area and road very well must I have all the conveyancing searches?
If you not getting a home loan, then all but one or two of the Iver conveyancing searches are non-obligatory. Your lawyer will try and sway you, perhaps strongly, that you should have searches carried out, but she is duty bound to take that path of guidance. One thing to take into account; if you are intend to dispose of the house in the future, it will be of relevance to your future buyer what the searches determine. Sometimes premises with functional issues can still throw up unfavourable search results. A competent conveyancing solicitor in Iver should be able to give you some sensible guidance in this regard.
It is a dozen years since I acquired my house in Iver. Conveyancing lawyers have just been appointed on the sale but I am unable to track down my title documents. Is this a problem?
Don’t worry too much. First there is a chance that the deeds will be kept by the mortgage company or they could stored with the conveyancers who acted in your purchase. Secondly in all probability the property will be registered at the land registry and you will be able to prove you are the registered owner by your conveyancing solicitors acquiring up to date copy of the land registers. The vast majority of conveyancing in Iver relates to registered property but in the rare situation where your property is not registered it is more of a problem but is resolvable.
We are purchasing a flat in Iver. I might seem paranoid but how we can trust a solicitor? At some point we have to put our life savings into their account. What is the protection we have from them run away with our monies?
Be assured that all money in a Solicitors client account is 100% safe, and even if your Solicitor ran off with it, the Law Society would reimburse you fully.
I am helping my step-mother sell her property in Iver. Does the solicitor arrange the energy performance certificate or it is for the owner to coordinate?
Following the demise of HIPs, energy performance certificates became a compulsory part of selling a house. An EPC needs to be commissioned in advance of the property being marketed. This is not as aspect of the sale process that conveyancers normally arrange. If you are instructing a Iver conveyancing practitioner they might help arrange EPC’s due to their relationships with long established Iver providers
I am selling my flat. I had a double glazing fitted in November 2008, but did not receive a FENSA certificate or Building Regulation Certificate. My purchaser’s lender, Co-operative are being pedantic. The Iver solicitor who is on the Co-operative conveyancing panel is recommending indemnity insurance as a solution but Co-operative are insisting on a building regulation certificate. Why do Co-operative have a conveyancing panel if they don't accept advice from them?
It is probably the case that Co-operative have referred the matter to their valuer. The reason why Co-operative may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing was correctly and safely installed. The indemnity insurance merely protects against enforcement action which is very unlikely anyway.
