My Conveyancer is not listed on the Together Personal Finance Conveyancing Panel. Can I still retain my preferred solicitor notwithstanding that they are excluded from the Together Personal Finance panel of approved conveyancing solicitors?
You have a number of options available to you here:
- Complete the purchase with your existing lawyers but Together Personal Finance will need to instruct a lawyer on the Together Personal Finance conveyancing panel. This will result in additional cost and potential delay.
- Get a new solicitor to act in the purchase, obviously checking they are on the Together Personal Finance conveyancing panel.
- Convince your lawyer to do everything within their powers to join the Together Personal Finance conveyancing panel
My conveyancer has identified an inconsistency between the assumptions in Together Personal Finance’s home valuation report and what is in the conveyancing documents. My lawyer informs me that as he is on the Together Personal Finance conveyancing panel he is duty bound to ensure that the lender is with this discrepancy and is content go ahead. Is my lawyer’s approach right?
A precondition to being on the Together Personal Finance approved panel is to comply with the CML Handbook requirements (last updated for this lender on Together Personal Finance) which do require that your lawyer disclose any incorrect assumptions in the lender’s valuation report and the legal papers. Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for both parties.
I have checked your search tool I can't find the lawyer I was hoping to instruct as being on the Together Personal Finance conveyancing panel. My lawyer has said that they are on the Together Personal Finance approved panel. How can I be sure given that they are not listed on your directory?
Not all firms are yet listed on our lender panel search tool which is still relatively new. Law firms are listing on a daily basis and it is probably the case that your lawyer is on the Together Personal Finance conveyancing lawyer and you should probably take them at their word. Please do feel free to suggest that they completing their listing on our site as it would only cost them £1 a month to list themselves as being on the Together Personal Finance solicitor panel.
I am in the process of remortgaging my home does my lawyer have to be on the Together Personal Finance Solicitor panel?
There is nothing to stop you using your solicitor but Together Personal Finance will insist on their interests being represented by a firm on their conveyancing panel. There is greater potential for delays and confusion with two solicitors involved, and it will undoubtedly be more expensive too.
We have had an offer accepted on a flat I spoke to a lawyer previously used by my dad and he advised retaining a solicitor approved by Together Personal Finance. The estate agent recommended two local firms so I asked Together Personal Finance if the 2 suggested solicitors are approved, which they are not. Together Personal Finance pointed out that either practice can fill out the appropriate forms to become approved. Do I (1) save myself the aggravation and use one of Together Personal Finance 's conveyancing panel solicitors (2) Use the local solicitor and accept there may be delays etc as they go through the approval process.
Ask Together Personal Finance to suggest a law firm in your location. Most banks have lawyers on their panel throughout the UK. You can also use our search tool at the top of this page to search for a lawyer on the Together Personal Finance conveyancing panel based on location. If you particularly like the sound of one of the local lawyers that you have spoken to ask them if they would go onto Together Personal Finance conveyancing panel as it may only take about 2-3 weeks. As long as they meet Together Personal Finance’s requirements it can be a very simple job for the solicitor. Other stuff will be going on in parallel (as you are at an early stage) so it may not delay matters.
I have paid off my mortgage with Together Personal Finance. I assume I don't need a solicitor on the Together Personal Finance panel to remove the mortgage at the Land Registry. Am I right?
If you have finished paying off your Together Personal Finance mortgage they may send you evidence showing that you have paid it off. Alternatively they may notify the Land Registry directly. The Land Registry need to see this evidence before they will remove the Together Personal Finance mortgage from the register. Together Personal Finance,and any evidence they send you, will determine the action you need to take. In cases where no conveyancer is acting for you and you have paid off your mortgage:
but are not moving to another property
where the Together Personal Finance has sent the Land Registry the discharge electronically, and
the Together Personal Finance has instructed the Land Registry to do so
The Land Registry will send you a letter confirming that your Together Personal Finance mortgage has been paid off.
At last I have had an offer on an apartment accepted, the seller does however have a dependent purchase. The vendors have offered on somewhere, but not been accepted yet, and have viewings of other properties in the pipeline. My conveyancing solicitor has been instructed. What do I do now? When should I get the mortgage app going with Together Personal Finance?
It is usual to have concerns where there is a chain as you are unlikely to want to be too out of pocket too early (mortgage application is approx £1k, then survey/valuation, conveyancing search costs, etc). First you should check that your solicitor is on the Together Personal Finance conveyancing panel. As to the next stages this very much depends on the circumstances of your case, desire for this property and on the state of the market. In a hot mortgage some buyers would pally for the mortgage with Together Personal Finance and pay for the valuation and only if it comes back ok would they pay their solicitor to press on with searches.
