My husband and I are buying a 1 bedroom apartment in Newcastle with a mortgage from RBS (One Account). We have a solicitor but RBS (One Account) says she’s not on their "panel". We have to appoint one of the RBS (One Account) panel solicitors or keep our solicitor and pay for one of their panel ones to represent them. We feel as though this is unjust; is there anything we can do?
No, not really. The mortgage offered to you is subject to its terms and conditions, one of which will be that lawyers will on the RBS (One Account) conveyancing panel. Until recently, most lenders had large numbers of law firms on their panels: a borrower could choose one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. Another option that might be available is for your solicitors to apply to be on the conveyancing panel for RBS (One Account)
My wife and I are refinancing our penthouse with RBS (One Account). We have a son 18 who lives with us. The solicitor on the RBS (One Account) conveyancing panel has asked us to disclose anyone over the age of 17 other than ourselves who lives in the flat. The solicitor has now sent a form for our son to sign, waiving any legal rights in the event that the flat is forfeited by the lender. I have two questions (1) Is this form unique to the RBS (One Account) conveyancing panel as he never had to sign this form when we purchased 4 years ago (2) Does our son by signing this giving up his rights to inherit the property?
First, rest assured that your RBS (One Account) conveyancing panel solicitor is doing the right thing as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to RBS (One Account) .This is solely used to protect the RBS (One Account) if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave.

It does not impact your son’s right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of RBS (One Account) had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.

I have checked your search tool I can't find the lawyer I was hoping to instruct as being on the RBS (One Account) conveyancing panel. My lawyer has said that they are on the RBS (One Account) approved panel. How can I be sure given that they are not listed on your directory?
Not all firms are yet listed on our lender panel search tool which is still relatively new. Law firms are listing on a daily basis and it is probably the case that your lawyer is on the RBS (One Account) conveyancing lawyer and you should probably take them at their word. Please do feel free to suggest that they completing their listing on our site as it would only cost them £1 a month to list themselves as being on the RBS (One Account) solicitor panel.
I was supposed to complete on my flat two days ago. My solicitor is on the RBS (One Account) solicitors panel but has moved offices 8 weeks ago and had not advised RBS (One Account) of their new address. This is a rare situation indeed. Most lender Terms of Conveyancing Panel Appointment specifically oblige the solicitor to inform the lender of an address change. Your solicitor needs to treat this with the utmost urgency. Do speak with or register your concern with the senior partner (assuming he or she is not your direct lawyer). Most lenders would be reasonable in this situation and expedite the resolution of this issue. It may be prudent to enlist the help of your local RBS (One Account) branch or your mortgage broker to see if they can assist.

Getting recommendations is a sensible starting point. Before you go ahead check if they offer a no sale no fee offer. Also you often get what you pay for - a firm which quotes more will often provide a better service than one which is cheap as chips. All banks and building societies have complaints procedures. Your first point of contact should be one of the RBS (One Account) branches or the Customer Care Department at RBS (One Account) head office. We understand that complaints to RBS (One Account) are resolved effectively and efficiently. However if you are not satisfied that the matter is resolved you can write to the Financial Ombudsman Service who will take matters further.
I can not work out if my mortgage offer requires a lease extension . I have telephoned RBS (One Account) on various occasions and told it wasn't a problem and they would lend. As long as the conveyancer is on the RBS (One Account) panel she or he must comply with the CML Handbook requirements for RBS (One Account). Unless your lawyer obtains specific confirmation in writing that RBS (One Account) will go ahead your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask RBS (One Account) to contact your lawyer in writing confirming that they will accept the remaining number of years left on the lease.
