I instructed a solicitor to work on my remortgage three weeks ago having applied for a mortgage with RBS (One Account). The firm confirmed to me that they are on RBS (One Account) conveyancing panel and provided me their panel number. RBS (One Account) then told me that their panel number was dormant and would need to be reactivated. What happens next? Should I appoint a new solicitor currently on the conveyancing panel for RBS (One Account)?
You may be very frustrated with the lawyer but if it only go take a few more days they it may be worth waiting as, depending on how far progressed you are you may end up delaying the transaction by a number of weeks if you need to replace your solicitor You may wish to enlist the help of your broker to check with the RBS (One Account) as to how long they think it will take to get the firm to get back on the panel.
My fiance and I changing mortgage lender for our penthouse with RBS (One Account). We have a son approaching twenty who lives with us. The solicitor on the RBS (One Account) conveyancing panel has asked us to disclose any adults other than ourselves who reside at the property. Our lawyer has now e-mailed a document for our son to sign, giving up any rights in the event that the flat is repossessed. I have two concerns (1) Is this form unique to the RBS (One Account) conveyancing panel as he never had to sign this form when we purchased 3 years ago (2) Does our son by signing this giving up his rights to inherit the property?
On the face of it your lawyer has done nothing wrong as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to RBS (One Account) .This is solely used to protect the RBS (One Account) if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave.
It does not impact your son’s right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of RBS (One Account) had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.

You can use any solicitor you like but RBS (One Account) then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the RBS (One Account) solicitors panel
I had instructed online conveyancers located in Birmingham who are on the RBS (One Account) solicitor panel. They are now charging me a separate fee of £195 for dealing with the RBS (One Account) mortgage. Is this an additional conveyancing fee specified by RBS (One Account)?
Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by RBS (One Account) but by your lawyers. Some firms on the RBS (One Account) will charge an ‘acting for lender’ fee but plenty of firms include it on their overall fee.

If you are getting a mortgage with RBS (One Account) involved you will need to appoint a solicitor on the RBS (One Account) conveyancing panel. We would not encourage you to both use the same solicitors' firm. There are clear conflict of interest issues and it's not going to make a huge difference to the speed of the overall process. So as not to hold things us you should pass on your solicitors details to RBS (One Account). My offer was accepted on a property on the 6th February 2014, valuation was booked 2 days later, all came back fine. Conveyancer instructed, so all that was missing was my mortgage offer. Having made daily calls to RBS (One Account) and chasing them on my offer I have now been told that my offer will not be issued unless the lawyer is on the RBS (One Account) conveyancing panel. Can the lender hold off the offer?
Mortgage companies tend not to not issue an offer until they have details of a lawyer on their panel. It can take a few weeks for RBS (One Account) to deal with your lawyers application to be on the RBS (One Account) conveyancing panel. There's no guarantee that your solicitors will be accepted.
