Precise Mortgages Conveyancing Panel : Questions and Answers
Is the fact that my solicitor is not identified on the Precise Mortgages Conveyancing panel that there is a problem with the quality of her work?
That would more than likely be a wrong assumption to make. There are all sorts of perfectly reasonable explanations. A recent report by the solicitors regulator indicated 76% of law firms surveyed had been removed from at least one lender panel. The most common reasons for removal are: (1) lack of transactions (2) the lawyer is a sole practitioner (3) as part of the HSBC panel reduction (4) regulatory contact by SRA (5) accidental removal. If you are concerned you should simply call the firm and ask them why they are no longer on the approved list for Precise Mortgages.
Our solicitor has identified a defect with the lease for the flat we are buying. The other side have put forward title insurance as a workaround. We are happy with insurance and will pay for it. Our solicitor says that as he is on the Precise Mortgages conveyancing panel he must be satisfied that the lender is happy with this solution. Who is the client here, us or Precise Mortgages?
Just because you have a mortgage offer from Precise Mortgages does not mean to say that the property will be meet their requirements for the purposes of a mortgage. Your lawyer has to ensure that the lease has to comply with the CML Handbook Requirements. You and Precise Mortgages are the client. The appropriate lender requirements must be adhered to by the Precise Mortgages conveyancing panel who has to balance acting for you and Precise Mortgages

I would like to get my ex-wife taken off the mortgage deeds. Can Precise Mortgages really insist on which solicitor I can or can not instruct?
You can use any solicitor you like but Precise Mortgages then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the Precise Mortgages solicitors panel
I have instructed a lawyer having checked that they are on the Precise Mortgages conveyancing panel. Does my lawyer arrange the survey of the property?
Or
I've read lots of house buying,I note that it is considered advisable to get your house surveyed prior to buying it. When I asked my solicitor - who is on the Precise Mortgages conveyancing panel - on this she said they don't do this and I need to contract an independent surveyor. Is that normal?
Precise Mortgages will need an independent valuation of the property. Your lawyer will not arrange this. Usually Precise Mortgages will appoint their own surveyor to do this, and you will have to pay for it. Remember that this is a valuation for mortgage purposes and not a survey.
You may wish to consider appointing your own surveyor to carry out a survey or prepare a home buyers report on the property. It is up to you to satisfy yourself that the property is structurally sound before you buy it. If the survey or report reveals that building work is needed, you should tell your solicitor. You may wish to renegotiate with the seller.
or
Your lawyer will not organise the survey but they may be able to put you in touch with a local one that they recommend. RICS offers a find a surveyor service (just google it) where you can search for a qualified surveyor by postcode. As you are getting a mortgage with Precise Mortgages you could contact your them to see if they have a list of approved surveyors.
Precise Mortgages have agreed my mortgage in principle, my offer on house has been accepted, now what?
The estate agent will want to know who your solicitors are (make sure these solicitors are on the lenders panel). Call up Precise Mortgages or your broker and complete any relevant paperwork. Precise Mortgages will tell you what documents they want. Precise Mortgages will instruct a valuer. The valuer will get in touch with the estate agent or seller to book an appointment. Once conducted (assuming no problems) it takes about week to get a mortgage offer. Precise Mortgages will issue the offer to you and your lawyer. The transaction will then take it’s course according the nature and complexity of the conveyancing.
My offer on house has been accepted, but there is a chain. The vendors have offered on somewhere, but not been accepted yet, and have viewings of other properties in the pipeline. My conveyancing solicitor has been instructed. What do I do now? At what point should I appy for the mortgage with Precise Mortgages?
It is usual to have concerns where there is a chain as you are unlikely to want to be too out of pocket too early (mortgage application is approx £1k, then survey/valuation, conveyancing search costs, etc). First you should check that your solicitor is on the Precise Mortgages conveyancing panel. As to the next stages this very much depends on the circumstances of your case, desire for this property and on the state of the market. In a hot mortgage some buyers would pally for the mortgage with Precise Mortgages and pay for the valuation and only if it comes back ok would they pay their solicitor to press on with searches.
