I am expecting a offer of a mortgage from Precise Mortgages. I would like to enlist the help of a Licensed Conveyancer. Does the Precise Mortgages Solicitor panel exclude conveyancers regulated by the CLC
Precise Mortgages’s conveyancing panel is, like many other lenders associated to the CML or BSA, open to Licensed Conveyancers regulated by the Council of Licensed Conveyancers.
My conveyancer has identified an inconsistency between the surveyor’s assumptions in Precise Mortgages’s home valuation report and what is revealed within the conveyancing documents. My solicitor says that as he is on the Precise Mortgages conveyancing panel he is obliged to ensure that the bank is OK with this discrepancy and is still content to lend. Is my conveyancer’s approach appropriate?
A precondition to being on the Precise Mortgages approved panel is to comply with the CML Handbook requirements (last updated for this lender on Precise Mortgages) which do require that your lawyer disclose any incorrect assumptions in the lender’s valuation report and the legal papers. Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for both parties.
Do I have to attend the offices of the Precise Mortgages conveyancing panel solicitor to sign the mortgage deed? If so, I will instruct a firm who offer conveyancing in Manchester
so that I can attend their offices if required.
As opposed to twenty years ago, most lenders no longer require their conveyancing panel solicitor to witness the borrowers signature. The firm that I appointed last week on my house acquisition in Hendon has suddenly closed. I only went with them because I needed a firm on the Precise Mortgages conveyancing panel and my preferred lawyer was not. I paid them £200 on account. What are my options?
Assuming that you have an Estate Agent in the equation then let them know straight away so that they advise the vendors that there may be a slight delay due to reasons beyond your control. Most sellers would be sympathetic and urge their lawyer to send a new set of papers to your new solicitors. You will need to appoint new lawyers that are on the Precise Mortgages conveyancing panel and notify the lender. If you have paid over any money it will hopefully be held by the SRA as money in an intervened firm's bank accounts is transferred to the SRA. Then, the SRA or the intervention agent looks at the intervened firm's accounts to work out who the money belongs to. To claim your money you will need to contact the SRA. If the SRA cannot return money you are owed from the firm's bank accounts, or if they can only return part of the money, you can apply to the Compensation Fund for a grant. Are all Conveyancing Quality Solicitors on the Precise Mortgages conveyancing panel?
A selection of lenders now use the accreditation scheme as the starting point for Panel approval such as HSBC and Santander. The Law Society’s CQS accreditation however is no guarantee to lender panel acceptance. That being said,the CML have indicated that it is likely to become a pre-requisite for firms wishing to join their panels.
I have a mortgage with Precise Mortgages. My father retired last week and wants to pay off the mortgage left on the property. After Precise Mortgages is paid, I want to transfer the property to my mother's name; How long does the process take? Do we need two separate solicitors on the Precise Mortgages conveyancing panel? I do not intend to live at the property once the Precise Mortgages mortgage is discharged.

will need a solicitor but they need not be on the Precise Mortgages conveyancing panel.
You will need a solicitor to draw up the transfer and
to deal with the Land Registry formalities. The only thing you need to
consider is that by selling at an undervalue so ask your lawyer about
the implications. There could be an inheritance tax issue if you die
within 7 years of this. As the property is your main residence you need
not pay CGT but you should speak with your accountants in any event.

Having read lots of house buying,I note that they all recommend that you should get your house surveyed prior to buying it. When I asked my solicitor - who is on the Precise Mortgages conveyancing panel - on this she said they don't do this and I need to contract an independent surveyor. Is that normal?
Precise Mortgages will need an independent valuation of the property. Your lawyer will not arrange this. Usually Precise Mortgages will appoint their own surveyor to do this, and you will have to pay for it. Remember that this is a valuation for mortgage purposes and not a survey.
You may wish to consider appointing your own surveyor to carry out a survey or prepare a home buyers report on the property. It is up to you to satisfy yourself that the property is structurally sound before you buy it. If the survey or report reveals that building work is needed, you should tell your solicitor. You may wish to renegotiate with the seller.

Your lawyer will not organise the survey but they may be able to put you in touch with a local one that they recommend. RICS offers a find a surveyor service (just google it) where you can search for a qualified surveyor by postcode. As you are getting a mortgage with Precise Mortgages you could contact your them to see if they have a list of approved surveyors.
