I am getting a mortgage with Perenna. I intend to employ the services of a Licensed Conveyancer. Does the Perenna Solicitor panel exclude Licensed Conveyancers
Perenna’s approved solicitor list is, like many other lenders associated to the Council or Mortgage Lenders or BSA, open to Licensed Conveyancers regulated by the CLC.
My conveyancer has discovered a discrepancy when comparing the surveyor’s assumptions in Perenna’s home valuation survey and what is in the conveyancing documents. My lawyer has advised that as he is on the Perenna conveyancing panel he is duty bound to check that the lender is OK with this discrepancy and is content go ahead. Is my solicitor’s stance correct?
A precondition to being on the Perenna approved panel is to comply with the CML Handbook requirements (last updated for this lender on Perenna) which do require that your lawyer disclose any incorrect assumptions in the lender’s valuation report and the legal papers. Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for both parties.
Your search tool is useful but there are many lawyers listed near Coventry on the Perenna conveyancing panel. Can you recommend a specific firm on the conveyancing panel for Perenna ?
We are not in the business of recommending one firm above another as the right firm for you depends on where your priorities lie. For example you may require a local firm with local knowledge or you might be looking for the low cost conveyancing. We recommend that you speak to 3 or 4 lawyers listed before you make your choice..
I am considering applying for a Perenna mortgage for purchase of a newly converted (under development) with 70% LTV. Is it compulsory to choose a solicitor on the conveyancing panel for Perenna?
In theory, you could use a solicitor that is not on Perenna conveyancing panel, but Perenna would require one of their panel solicitors to be instructed to act in their interests, and you'd have to pay for this - so most people instruct a panel solicitor. It's also easier, as otherwise you'd have to deal with two solicitors for the same conveyancing matter.
I'm in the process of viewing flats and am about to put in an offer. Is it best to have a conveyancer on ‘stand by’? I intend to finance via a home loan with Perenna
You should start obtaining conveyancing quotes from solicitors ASAP. After you have chosen your lawyer and once your offer is accepted you can instruct them to work for you and pass their details on the the estate agent. As you are getting a mortgage with Perenna , make sure you remember to check that your lawyer is on the Perenna conveyancing panel.
My ex -wife’s name is on the Perenna mortgage of my property but not on the land registry. The apartment was transferred to me on our divorce many years ago by way of a sealed court order. Does my ex still have a say on the sale even though the land registry showing the property in my name alone? Will I be required to take her name of the Perenna mortgage in order to sell?
In terms of the Perenna mortgage, it is unusual that your ex-wife’s name remains on the mortgage but not on the title. It is conceivable that this is an oversight on the part of your conveyancers to ensure that her name was removed or even an administrative error on the part of Perenna in failing to update their data. In any event, it should cause difficulty providing her name no longer appears on the Land Registry title and you have a court order ordering that the property is transferred to you.
My offer on house has been accepted, but there is a chain. The vendors have offered on somewhere, but not been accepted yet, and have viewings of other properties in the pipeline. My conveyancing solicitor has been instructed. What should be my next step? When should I get the mortgage app going with Perenna?
It is usual to have concerns where there is a chain as you are unlikely to want to be too out of pocket too early (mortgage application is approx £1k, then survey/valuation, conveyancing search costs, etc). First you should check that your solicitor is on the Perenna conveyancing panel. As to the next stages this very much depends on the circumstances of your case, desire for this property and on the state of the market. In a hot mortgage some buyers would pally for the mortgage with Perenna and pay for the valuation and only if it comes back ok would they pay their solicitor to press on with searches.
