Frequently asked questions relating to the Paragon Mortgages Conveyancing Panel

My property lawyer is not listed on the Paragon Mortgages Solicitor Panel. Is it possible for me to retain my family solicitor notwithstanding that they are excluded from the Paragon Mortgages panel?
You have a number of options available to you here:
  1. Carry on with your preferred lawyers but Paragon Mortgages will need to instruct a lawyer on the Paragon Mortgages conveyancing panel. This will result in additional cost and potential delay.
  2. Get a new solicitor to act in the purchase, obviously checking they are on the Paragon Mortgages conveyancing panel.
  3. Convince your lawyer to do everything within their powers to join the Paragon Mortgages conveyancing panel
My husband and I are refinancing our maisonette with Paragon Mortgages. We have a son 19 who lives with us. The solicitor on the Paragon Mortgages conveyancing panel has asked us to disclose any adults other than ourselves who lives in the flat. The solicitor has now sent a form for our son to sign, giving up any rights in the event that the property is forfeited by the lender. I have two questions (1) Is this document specific to the Paragon Mortgages conveyancing panel as he did not need to sign this form when we purchased 5 years ago (2) Does our son by signing this giving up his rights to inherit the property?
On the face of it your lawyer has done nothing wrong as it is established procedure for any occupier who is aged 17 or over to sign the necessary Consent Form, which is purely to state that any rights he has in the property are postponed and secondary to Paragon Mortgages .This is solely used to protect the Paragon Mortgages if the property were re-possessed so that in such circumstances, your son would be legally obliged to leave.

It does not impact your son’s right to inherit the apartment. Please note that if your son were to inherit and the mortgage in favour of Paragon Mortgages had not been discharged, he would be liable to take over the loan or pay it off, but other than that, there is nothing stopping him from keeping the property in accordance with your will or the rules of intestacy.

Is it necessary during the course of the conveyancing process to visit the offices of the Paragon Mortgages conveyancing panel solicitor to sign the legal charge? If so, I will instruct a firm who offer conveyancing in Manchester so that I can attend their offices when needed.
Most conveyancing panel lawyers for Paragon Mortgages undertake all of the work via the post, internet or over the phone. This means that they can undertake your Conveyancing Transaction no matter where you live in England or Wales. However you should check if you can still book an appointment to go into appointed conveyancing lawyer if you prefer.
I would like to get my ex-husband removed the mortgage deeds. Can Paragon Mortgages really tell me which solicitor I can or can not use?
You can use any solicitor you like but Paragon Mortgages then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the Paragon Mortgages solicitors panel
Can you point me to a directory of Paragon Mortgages panel conveyancers on the Building Society Association’s Website?
No. There is no such tool on the Council of Mortgage Lenders or Building Society Association websites. Very few lenders make their panel listings available online.
Why might a lender such as Paragon Mortgages withdraw a mortgage offer?
Banks and Building Societies such as Paragon Mortgages can revoke their mortgage offer although this is unusual. In the unlikely event that Paragon Mortgages withdraw their offer they may or may not inform you or the lawyer as to the reasons why. There are various possible reasons but here are 5 examples:
  • Where information comes to Paragon Mortgages ‘s attention regarding the customers or the security that they were not aware of prior to offer that affects their original decision to lend
  • A cashback to the buyer, or | part of the price includes a non-cash incentive to the buyer (eg paid stamp duty land tax),or | any indirect incentive (cash or non cash) or rental guarantee, of which the lender was previously unaware
  • Where the purchase price and borrowers direct contribution differ to details on the mortgage application form completed by the borrower
  • Where the sale is not at arms length for value to unconnected persons
  • If the lender reasonably suspects that the applicant, borrower, mortgagor or guarantor is involved in any criminal or fraudulent activity, including trading in illegal drugs or other substances, theft, robbery, deception or other serious offences, or if the applicant borrower, mortgagor or guarantor has a conviction for any serious criminal offence, including theft, deception, fraud, robbery or trade in illegal drugs or other substances;
I have agreed a price on a apartment I spoke to a solicitor recommended by my brother and he advised instructing a solicitor approved by Paragon Mortgages. The estate agent recommended two local firms so I asked Paragon Mortgages if the 2 suggested solicitors are approved, which they are not. Paragon Mortgages pointed out that either firm can fill out the appropriate forms to become approved. Do I (1) save myself the aggravation and use one of Paragon Mortgages 's conveyancing panel solicitors (2) Use the local solicitor and accept there may be delays etc as they go through the approval process.
