Is the fact that my conveyancer is not identified on the Intelligent Finance Conveyancing panel that there is a problem with the quality of the firm’s work?
It would not be wise to jump to that conclusion. There are all sorts of perfectly reasonable explanations. A recent report by the solicitors regulator indicated 76% of law firms surveyed had been removed from at least one lender panel. The most common reasons for removal are: (1) lack of transactions (2) the lawyer is a sole practitioner (3) as part of the HSBC panel reduction (4) regulatory contact by SRA (5) accidental removal. If you are concerned you should simply call the firm and ask them why they are no longer on the approved list for Intelligent Finance.
We are approaching an exchange and my parents having sent the 10% deposit to my lawyer. I am now advised that as the deposit has not come from me my lawyer needs to make a notification to my lender Intelligent Finance. Apparently, being on the Intelligent Finance conveyancing panel and acting on their behalf he must inform Intelligent Finance if the balance of the mortgage advance is not just from me. I disclosed to the bank about my parent’s contribution when I applied for the mortgage so is it really necessary for this now to be an issue?
Your lawyer is obliged to check with Intelligent Finance to make sure that they are aware that the balance of the purchase price is not from your own funds. Your solicitor can only report this to Intelligent Finance if you agree, failing which, your lawyer must cease to continue acting.
How do I find a local solicitor on the Intelligent Finance conveyancing panel? I have a car and am prepared to travel up to 10 kilometers to meet the lawyer.
You can use the find a conveyancing panel tool on this page. Please choose the lender and your location and you will see a number of lawyer located nearest you. I am attempting to get my ex-wife removed the mortgage deeds. Can Intelligent Finance really insist on which solicitor I can or can not instruct?
You can use any solicitor you like but Intelligent Finance then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the Intelligent Finance solicitors panel
We have had an offer accepted on a house I spoke to a lawyer recommended by my dad and he recommended retaining a solicitor approved by Intelligent Finance. The estate agent recommended two local firms so I asked Intelligent Finance if the 2 suggested solicitors are approved, which they are not. Intelligent Finance pointed out that either firm can fill out the appropriate forms to become approved. Do I (1) save myself the aggravation and use one of Intelligent Finance 's conveyancing panel solicitors (2) Use the local solicitor and accept there may be delays etc as they go through the approval process.
Ask Intelligent Finance to suggest a law firm in your location. Most banks have lawyers on their panel throughout the UK. You can also use our search tool at the top of this page to search for a lawyer on the Intelligent Finance conveyancing panel based on location. If you particularly like the sound of one of the local lawyers that you have spoken to ask them if they would go onto Intelligent Finance conveyancing panel as it may only take about 2-3 weeks. As long as they meet Intelligent Finance’s requirements it can be a very simple job for the solicitor. Other stuff will be going on in parallel (as you are at an early stage) so it may not delay matters.
I currently have a mortgage with with Intelligent Finance. Conveyancing was finalised 12 months ago. In the event that I decide to rent out my property and do not currently have a buy-to-let mortgage do I need to remortgage to a buy-to-let mortgage or inform Intelligent Finance?
Intelligent Finance must be informed of your intention prior to renting your property as this is likely to be a breach of Intelligent Finance’s mortgage conditions. In many cases banks or building societies will permit you to let out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. You should contact Intelligent Finance directly. You need not do this via a Intelligent Finance conveyancing panel firm.
My ex -wife’s name is on the Intelligent Finance mortgage of my property but not on the land registry. The apartment was transferred to me on our divorce many years ago by way of a sealed court order. Does my ex still have a say on the sale even though the land registry showing the property in my name alone? Will I be required to take her name of the Intelligent Finance mortgage in order to sell?
In terms of the Intelligent Finance mortgage, it is unusual that your ex-wife’s name remains on the mortgage but not on the title. It is conceivable that this is an oversight on the part of your conveyancers to ensure that her name was removed or even an administrative error on the part of Intelligent Finance in failing to update their data. In any event, it should cause difficulty providing her name no longer appears on the Land Registry title and you have a court order ordering that the property is transferred to you.
