Can you please explain the reason why all property lawyers aren't included on the Hinckley and Rugby Solicitor panel?
Hinckley and Rugby and other mortgage companies ordinarily imposes restrictions either the type or the number of conveyancing solicitors on their approved list of lawyers. Typical examples of such restriction(s) being that a firm must have two or more partners. In addition to restricting the type of firm, some have decided to limit the number of firms they use to represent them. Mortgage fraud was a key driver in the rationalisation of conveyancing panels a few years ago and whilst there are differing views about the extent of solicitor involvement in some of that fraud. My lawyer is asking me for proof of ID documents saying that this forms part of his obligations as a solicitor on the Hinckley and Rugby Solicitor panel. Can this be correct?
Due to Money Laundering Regulations your conveyancing lawyer is duty bound to confirm positively your identification when entering into a business relationship with you. It is a criminal offense if your lawyer not do this. If you do not provide ID early in the transaction the solicitor must refuse to act for you. It’s unlikely a lawyer will turn you away if you come to the first meeting without relevant ID but you will have to produce it at some point so you might as well bring it with you to the initial meeting so the lawyer can tick the ID verification box and start sorting out the conveyancing straight away. If you are getting a mortgage with Hinckley and Rugby your lawyer also has to check ID documents to satisfy Hinckley and Rugby

It very much depends from lender to lender but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years. We have agreed a price on a flat I spoke to a lawyer previously used by my brother and he recommended retaining a solicitor approved by Hinckley and Rugby. The estate agent recommended two local firms so I asked Hinckley and Rugby if the 2 suggested solicitors are approved, which they are not. After much negotiation I have agreed a price on a house. My mortgage broker suggested a solicitor I paid an upfront payment of 150. Soon after the conveyancers contacted me sheepishly admitting that they were not on the Hinckley and Rugby conveyancing panel. Am I right in thinking that I should be due a refund?
You should be able to recover this from the law firm if they were not on the Hinckley and Rugby panel. They should have asked at the outset which lender you were obtaining a mortgage with. An important lesson to readers of this site is to check that the lawyers are on the appropriate lender panel.
