I instructed a solicitor to work on my remortgage 4 weeks ago having applied for a mortgage with Habito. The law firm assured me that they are on Habito conveyancing panel and provided me their panel reference. Habito then told me that their panel number was dormant and would need to be reactivated. What do I do from here? Do I instruct a different law firm listed on the approved panel for Habito?
The answer depends on whether you still have confidence in the said solicitors and how long it will take for the firm to be reinstated on the Habito conveyancing panel You may wish to enlist the help of your broker to check with the Habito as to how long they think it will take to get the firm to get back on the panel.
We are getting closer to an exchange and my parents having transferred the 10% deposit to my lawyer. I am now advised that as the deposit has not come from me my lawyer needs to disclose this to my lender Habito. Your lawyer is obliged to check with Habito to make sure that they are aware that the balance of the purchase price is not from your own funds. Your solicitor can only report this to Habito if you agree, failing which, your lawyer must cease to continue acting.

The fact that your lawyer is on the Habito conveyancing panel is a help. It would almost certainly delay matters if they were not. However, no conveyancer should guarantee a time-frame for your conveyancing due to third parties outside of our control such as delays caused by lenders,conveyancing search providers or by the other side’s solicitors. The estate agent recommended two local firms so I asked Habito if the 2 suggested solicitors are approved, which they are not. In many cases banks or building societies will allow you to rent out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. As to the next stages this very much depends on the circumstances of your case, desire for this property and on the state of the market. In a hot mortgage some buyers would pally for the mortgage with Habito and pay for the valuation and only if it comes back ok would they pay their solicitor to press on with searches.
