My property lawyer has never been on on the Gen H Approved Panel. Can I still continue with my preferred solicitor notwithstanding that they are not on the Gen H panel?
You will need to have a conveyancer complete the legal work required when you take out a Gen H mortgage to buy your property. They’ll carry out all the necessary legal checks on the property, make sure that you’re properly registered as the owner and ensure that all the necessary mortgage documentation is in place. You can instruct a conveyancing firm of your choice. However, if the firm selected is not a member of the Gen H conveyancing panel additional costs will be incurred as separate legal representation will be required by Gen H. Conveyancing panel applications can be submitted, so if your conveyancer has not previously applied for membership they can do so.
We are due to exchange on the purchase a house but as a result of damage from the recent storms I have agreed compensation from the seller of £3k approx by way of a reduction in the price. This was going to be dealt with as part of the conveyancing process but my mortgage company Gen H will not agree to this. Why was Gen H even consulted?
Your lawyer being on the Gen H conveyancing panel is duty bound to inform Gen H of any changes to the purchase price. If you were to refuse your lawyers to disclose the reduction to Gen H then they would have to discontinue acting for you and Gen H.
Having used your search tool I can't find the lawyer I was hoping to instruct as being on the Gen H conveyancing panel. My lawyer has said that they are on the Gen H approved panel. How can I be sure given that they are not listed on your directory?
Not all firms are yet listed on our lender panel search tool which is still relatively new. Law firms are listing on a daily basis and it is probably the case that your lawyer is on the Gen H conveyancing lawyer and you should probably take them at their word. Please do feel free to suggest that they completing their listing on our site as it would only cost them £1 a month to list themselves as being on the Gen H solicitor panel.
My lawyers in Newcastle have advised me that they can not locate my conveyancing file. To assist with my purchase I took out a mortgage with Gen H. Is it case that being on the Gen H conveyancing panel they need to have retained the file for a number of years?
Different lenders have different requirements but many of the Terms and Conditions of Conveyancing Panel Appointment require the file to be held for a period of 6 years. That being said we have not seen a copy of the Gen H Conveyancing Panel Terms. It might be worth you contacting Gen H directly.

Some lenders take longer than others. Have Gen H done the valuation? Have you advised Gen H as your lawyers details and checked that your lawyer is on the Gen H conveyancing panel? sometimes it can take as long as six weeks for a mortgage offer to be issued
I am due to exchange contracts on my flat. I had a double glazing fitted in month 8 but did not receive a FENSA certificate or Building Regulation Certificate. My buyer's lender, Gen H are being difficult. The solicitor who is on the Gen H conveyancing panel is happy to accept ‘lack of building regulation’ insurance but Gen H are insisting on a building regulation certificate. Why do Gen H have a conveyancing panel of they don’t accept advice from them?
It is probably the case that Gen H have referred the matter to their valuer. The reason why Gen H may not want to accept indemnity insurance is because it does not give them any reassurance that the double glazing correctly and safely installed. It merely protects against enforcement action which is very unlikely anyway.
I was told three weeks ago that my mortgage has been agreed
to by Gen H. Is it usual for Gen H to only issue the offer once my
solicitor is approved on their conveyancing panel?
A lender would not issue an offer until they have details of a lawyer on their panel. It can take a few weeks for Gen H to deal with your lawyers application to be on the Gen H conveyancing panel. There's no guarantee that your solicitors will be accepted.
