Find an Approved Solicitor on the Foundation Home Loans Conveyancing Panel

Foundation Home loans Conveyancing Panel : Questions and Answers

My Conveyancer has never been on on the Foundation Home loans Solicitor Panel. Is it possible for me to retain my preferred solicitor even though they are excluded from the Foundation Home loans panel?
You will need to have a conveyancer complete the legal work required when you take out a Foundation Home loans mortgage to buy your property. They’ll carry out all the necessary legal checks on the property, make sure that you’re properly registered as the owner and ensure that all the necessary mortgage documentation is in place. You can instruct a conveyancing firm of your choice. However, if the firm selected is not a member of the Foundation Home loans conveyancing panel additional costs will be incurred as separate legal representation will be required by Foundation Home loans. Conveyancing panel applications can be submitted, so if your conveyancer has not previously applied for membership they can do so.
We are due to exchange on the purchase a house but as a result of damage from the recent storms I have agreed compensation from the seller of £3k approx by way of a reduction in the price. This was going to be dealt with as part of the conveyancing process but my mortgage company Foundation Home loans will not agree to this. Why was Foundation Home loans even consulted?
Your lawyer being on the Foundation Home loans conveyancing panel is duty bound to inform Foundation Home loans of any changes to the purchase price. If you were to refuse your lawyers to disclose the reduction to Foundation Home loans then they would have to discontinue acting for you and Foundation Home loans.
Your search tool is useful but there are many lawyers listed near Coventry on the Foundation Home loans conveyancing panel. It would be a lot more helpful if you could recommend a specific firm on the conveyancing panel for Foundation Home loans ?
We are not in the business of recommending one firm above another as the right firm for you depends on where your priorities lie. For example you may require a local firm with local knowledge or you might be looking for the low cost conveyancing. Before you appoint your lawyer we advise you to speak to two or three of the firms listed to gain comfort as to which one is right for you..
I was scheduled to move into my flat last Friday. My lawyer’s firm is on the Foundation Home loans solicitors panel but has changed address in the past couple of months and had not advised Foundation Home loans of their new address. Foundation Home loans has locked down the release of mortgage funds as the information from the solicitors isn't correct.
This is as unusual as it is unlucky. Most lender Terms of Conveyancing Panel Appointment specifically oblige the solicitor to inform the lender of an address change. Your solicitor needs to treat this with the utmost urgency. Do speak with or register your concern with the senior partner (assuming he or she is not your direct lawyer). Most lenders would be reasonable in this situation and expedite the resolution of this issue. It may be prudent to enlist the help of your local Foundation Home loans branch or your mortgage broker to see if they can help.
Are all Conveyancing Quality Solicitors on the Foundation Home loans conveyancing panel?
A selection of banks and building societies now use CQS as the starting point for Panel membership such as HSBC and Santander. CQS accreditation however gives no guarantee to lender panel acceptance. That being said, the Council of Mortgage Lenders have indicated that it is likely to become a pre-requisite for firms wishing to join their approved list of conveyancing solicitors.
I have not been happy with the level or service received from my lawyer. Is there a Foundation Home loans conveyancing panel complaints department or do I complain directly to the law firm?
Complaining to Foundation Home loans about their conveyancing panel is unlikely to yield much of a response. Every solicitor firm and conveyancer must have a complaints procedure. You can get information from the solicitor’s or conveyancer’s website or ask at their office. They must tell you about it if you ask.

The Legal Ombudsman will make sure that your complaint is addressed by the solicitor. It can also advise you how to complain.

If a licensed conveyancer does not have a complaints procedure or will not tell you about it, contact the Council for Licensed Conveyancers (CLC), which will make sure that your complaint is properly dealt with by the conveyancer. Please see below for more information.

I have instructed a lawyer having made sure that they are on the Foundation Home loans conveyancing panel. Does my lawyer arrange the survey of the property? Or Having digested plenty of house buying,I note that they all recommend that you should get your house surveyed prior to buying it. When I asked my solicitor - who is on the Foundation Home loans conveyancing panel - on this she said they don't do this and I need to contract an independent surveyor. is that correct?
Foundation Home loans will need an independent valuation of the property. Your lawyer will not arrange this. Usually Foundation Home loans will appoint their own surveyor to do this, and you will have to pay for it. Remember that this is a valuation for mortgage purposes and not a survey. You may wish to consider appointing your own surveyor to carry out a survey or prepare a home buyers report on the property. It is up to you to satisfy yourself that the property is structurally sound before you buy it. If the survey or report reveals that building work is needed, you should tell your solicitor. You may wish to renegotiate with the seller. or Your lawyer will not organise the survey but they may be able to put you in touch with a local one that they recommend. RICS offers a find a surveyor service (just google it) where you can search for a qualified surveyor by postcode. As you are getting a mortgage with Foundation Home loans you could contact your them to see if they have a list of approved surveyors.
