I am obtaining a mortgage offer from Family Building Society. my intention is to instruct a Licensed Conveyancer. Does the Family Building Society Solicitor panel allow for Licensed Conveyancers
Family Building Society’s approved solicitor list is, like many other lenders represented by the CML or BSA, open to Licensed Conveyancers regulated by the CLC.
My solicitor has spotted an inconsistency when comparing the surveyor’s assumptions in Family Building Society’s valuation report and what is revealed within the legal papers for the property. My solicitor has advised that as he is on the Family Building Society conveyancing panel he needs to ensure that the lender is with this discrepancy and is content go ahead. Is my lawyer’s course or action correct?
A precondition to being on the Family Building Society approved panel is to comply with the CML Handbook requirements (last updated for this lender on Family Building Society) which do require that your lawyer disclose any incorrect assumptions in the lender’s valuation report and the legal papers. Should you refuse to allow your lawyer to make the appropriate notification then your lawyer will have no choice but to discontinue acting for both parties.

Please explain the implications if my solicitor is suspended from the Family Building Society Solicitor panel prior to the completion date?
First, this is very unlikely to happen. In most cases even where a law firm is removed off of a panel the lender would allow the completion to go ahead as the lender would appreciate the difficulties that they would place you in if you have ti instruct a new solicitor days before completion. In a worst case scenario where the lender insists that you instruct a new firm then it is possible for a very good lawyer to expedite the conveyancing albeit that you may pay a significant premium for this. The analogous situation is where a buyer instructs a lawyer, exchanges contracts and the law firm is shut down by the regulator such as the SRA. Again, in this situation you can find lawyers who can troubleshoot their way to bring the conveyancing to a satisfactory conclusion - albeit at a cost.
Can I be sure that the solicitor on the Family Building Society panel is any good?
obtaining recommendations is a good start. Before you go ahead check if they offer a no sale no fee offer. Also you often get what you pay for - a firm which quotes more will often provide a better service than one which is cheap as chips. Complaining to Family Building Society about their conveyancing panel is unlikely to yield much of a response. All solicitors and conveyancer must have a complaints procedure. Usually one can find this information from the solicitor’s or conveyancer’s website or ask at their office. They must tell you about it if you ask.

The Legal Ombudsman will make sure that your complaint is properly dealt with by the solicitor. It can also advise you how to complain.
