My Conveyancer is not listed on the Capital Home Loans Approved Panel. Is it possible for me to use my family solicitor notwithstanding that they are not on the Capital Home Loans list of approved lawyers?
The most common options here are as follows:
  1. Complete the purchase with your preferred solicitors but Capital Home Loans will need to instruct a lawyer on the Capital Home Loans conveyancing panel. This will result in additional cost and potential delay.
  2. Get a new solicitor to act in the purchase, obviously checking they are on the Capital Home Loans conveyancing panel.
  3. Urge your lawyer to apply to join the Capital Home Loans lender panel
Can you clarify something for me?. For no fault of my lawyer but, the conveyancing for my house purchase has been going on for months. The Local Authority Search from Capital Home Loans was date stamped random date and we have agreed a date for me to move into the property on Tues etc. My lawyer informs me that as she is on the Capital Home Loans conveyancing panel she needs to redo the searches as they are no longer acceptable to the lender.
A precondition to being on the Capital Home Loans approved panel is to comply with the CML Handbook Part 2 obligations (last updated for this lender on Capital Home Loans)which specifies that a local authority search be not more than half a year old. You should nevertheless ask your lawyer to check whether something called ‘search validation’ indemnity insurance is acceptable to Capital Home Loans.
Whilst your website is a good idea there are many lawyers listed near Leeds on the Capital Home Loans conveyancing panel. It would be a lot more helpful if you could recommend a specific firm on the conveyancing panel for Capital Home Loans ?
We do not recommend specific firms as the right firm for you depends on where your priorities lie. For example you may require a local firm with local knowledge or you might be looking for the low cost conveyancing. We recommend that you speak to 3 or 4 lawyers listed before you make your choice..
I am considering applying for a Capital Home Loans mortgage for purchase of a new build (under development) with 70% LTV. Is it compulsory to choose a solicitor on the conveyancing panel for Capital Home Loans?
In theory, you could use a solicitor that is not on Capital Home Loans conveyancing panel, but Capital Home Loans would require one of their panel solicitors to be instructed to act in their interests, and you'd have to pay for this - so most people instruct a panel solicitor. It's also easier, as otherwise you'd have to deal with two solicitors for the same conveyancing matter.
When it comes to lenders such as Capital Home Loans do solicitors have to be pay a fee to be on the conveyancing panel?
We are not aware of any lender fees to be on their panel although some do charge an administration charge to deal with the processing of the conveyancing panel application.
is it true that all conveyancing solicitors on the Capital Home Loans conveyancing panel regulated by the Solicitors Regulatory Authority?
As solicitors, in order to be on the Capital Home Loans conveyancing panel they would need to be regulated by the Solicitors Regulatory Authority. Many lenders do allow licenced conveyancers on their panel in which case such firms would be regulated by the Council of Licensed Conveyancers (CLC).
I had instructed online conveyancers located in Cardiff who are on the Capital Home Loans solicitor panel. They have just invoiced me a separate fee of £150 for the legal aspects of the Capital Home Loans mortgage. Is this an additional conveyancing fee specified by Capital Home Loans?
Unfortunately, as long as it is in their Terms and Conditions or Quote then yes your solicitors can charge a fee for this. This fee is not set by Capital Home Loans but by your lawyers. Some firms on the Capital Home Loans will charge an ‘acting for lender’ fee but plenty of firms include it on their overall fee.
