My husband and I are FTBs. Within the last couple of days our property lawyer has sent a preliminary report and documents to look through in anticipation of exchanging contracts shortly. Cynergy Bank have this afternoon contacted us to advise us that they have now hit a problem as our lawyer is not on their conveyancing panel. Is this a problem?
If you are buying a property with the assistance of a mortgage it is usual for the purchaser's solicitors to also act for the purchaser's lender.
In order to act for a bank or building society a law firm has to be on that lender's conveyancing panel. An application has to be made by the law firm to the lender to become a member of the lender's panel and there are increasingly strict criteria which the firm has to satisfy and indeed some lenders now require their panel members to be part of the Law Society’s Conveyancing Accreditation Scheme.
Your solicitors should contact Cynergy Bank and see if they can apply for membership of the Cynergy Bank conveyancing panel, but if that is not viable Cynergy Bank will instruct their own lawyers to represent them. You are not legally obliged to appoint a law firm on the Cynergy Bank conveyancing panel as you are at liberty to use your preferred lawyers, in which case your legal fees may increase, and it will likely delay the transaction as you are adding another lawyer into the mix.

Any lawyer on the Cynergy Bank conveyancing panel would need to check that the following risks are covered fire; lightning; aircraft; explosion; earthquake; storm; flood; escape of water or oil; riot; malicious damage; theft or attempted theft; falling trees and branches and aerials; subsidence; heave;landslip;collision;accidental damage to underground services;professional fees, demolition and site clearance costs; and public liability to anyone else. There are some other issues such as the level of excess that are set out in Cynergy Bank’s Part 2 requirements of the CML Handbook (last updated on Cynergy Bank). Being on the Cynergy Bank conveyancing panel your lawyer is expect to follow these requirements.
I see that you have a post code search directory listing firms on the Cynergy Bank conveyancing panel. Do firms pay you a referral fee if I instruct them for my house purchase?
We are a listing service only for law firms wishing to communicate if they are on the Cynergy Bank conveyancing panel or other lender panels. We do not charge referral fees to the any conveyancer that you subsequently appoint.
I am trying to get my former partner taken off the mortgage deeds. Can Cynergy Bank really insist on which solicitor I can or can not instruct?
You can use any solicitor you like but Cynergy Bank then has the right to appoint a different solicitor to act for them at your expense. It might be more cost effective and quicker to instruct a lawyer who is on the Cynergy Bank solicitors panel
is it true that all solicitor firms on the Cynergy Bank conveyancing panel overseen by the SRA?
As a firm of solicitors, in order to be on the Cynergy Bank conveyancing panel they would need to be regulated by the SRA. Many lenders do allow licenced conveyancers on their panel in which case such firms would be regulated by the Council of Licensed Conveyancers (CLC).
I am about to exchange contracts on a purchase with a mortgage from Cynergy Bank. The report from my solicitor mentions that Cynergy Bank could withdraw their offer before completion. Is this right?
Banks and Building Societies such as Cynergy Bank can withdraw their mortgage offer although this is unusual. In the unlikely event that Cynergy Bank withdraw their offer they may or may not inform you or the lawyer as to their reasoning. There are many potential reasons but here are 5 examples:

If the financial circumstances of the borrower have changed to the detriment and the Cynergy Bank has been notified

If the borrower informs Cynergy Bank of a change in security address

Situations where information provided by the borrower that enabled the lender to make a lending decision is fraudulent, incorrect or misleading.

Where to proceed with the Mortgage offer would be unlawful

If the lender reasonably suspects that the applicant, borrower, mortgagor or guarantor is involved in any criminal or fraudulent activity, including trading in illegal drugs or other substances, theft, robbery, deception or other serious offences, or if the applicant borrower, mortgagor or guarantor has a conviction for any serious criminal offence, including theft, deception, fraud, robbery or trade in illegal drugs or other substances;
Planning on purchasing a flat with a mortgage with Cynergy Bank. I have received an online quote from a licensed conveyancer, which states: "There will be no charge for dealing with the Building Society if you are obtaining a mortgage". I take this to mean that there will be no additional fee if the solicitor is on the Cynergy Bank conveyancing panel. I wanted to make sure it means there will be no additional fees for dealing with the mortgage.
They are simply saying that the cost for acting for the lender is included in the fee being quoted. It is worth you checking that they are on the Cynergy Bank conveyancing panel
