My husband and I are purchasing a 2 bedroom flat in Newcastle with a mortgage from April Mortgages. We have a solicitor but April Mortgages says she’s not on their "panel". We have to appoint one of the April Mortgages panel firms or keep our solicitor and pay for one of their panel ones to represent them. We feel as though this is unjust; Can we not simply insist that April Mortgages use our lawyer?
No, not really. The mortgage offered to you is subject to its terms and conditions, one of which will be that lawyers will on the April Mortgages conveyancing panel. Until recently, most lenders had large numbers of law firms on their panels: a borrower could choose one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. Please assist. My lawyer is not to blame but, my purchase conveyancing has been going on for months. A precondition to being on the April Mortgages approved panel is to comply with the CML Handbook requirements (last updated for this lender on April Mortgages)which states that a local authority search be not more than 6 months old. I was due to move into my flat last Thursday. My lawyer’s firm is on the April Mortgages solicitors panel but has changed address in the past couple of months and had not informed April Mortgages of their new address. April Mortgages is now refusing to release my funds until such time as their systems are up to date with the correct details.
This is as unusual as it is unlucky. Most lender Terms of Conveyancing Panel Appointment specifically oblige the solicitor to inform the lender of an address change. Your solicitor needs to treat this with the utmost urgency. Do speak with or register your concern with the senior partner (assuming he or she is not your direct lawyer). Most lenders would be reasonable in this situation and expedite the resolution of this issue. It may be prudent to enlist the help of your local April Mortgages branch or your mortgage broker to see if they can help.
Are all solicitor firms on the April Mortgages conveyancing panel regulated by the SRA?
As solicitors, in order to be on the April Mortgages conveyancing panel they would need to be regulated by the Solicitors Regulatory Authority. Many lenders do allow licenced conveyancers on their panel in which case such firms would be regulated by the Council of Licensed Conveyancers (CLC).
I am about to exchange contracts on a purchase with a mortgage from April Mortgages. The report from my solicitor mentions that April Mortgages could withdraw their offer before completion. Is this right?
Lenders such as April Mortgages can withdraw their mortgage offer although this rarely happens. should April Mortgages withdraw their offer they may or may not inform you or the lawyer as to their reasoning. There are various possible reasons but here are a number of examples:
  • April Mortgages may amend or withdraw an offer if the April Mortgages conveyancing panel solicitor is unable to confirm compliance with any of the conditions of the mortgage offer or if any of the terms of the mortgage offer cannot be satisfied
  • If the financial circumstances of the borrower have changed to the detriment and the April Mortgages has been notified
  • A cashback to the buyer, or | part of the price includes a non-cash incentive to the buyer (eg paid stamp duty land tax),or | any indirect incentive (cash or non cash) or rental guarantee, of which the lender was previously unaware
  • Situations where information provided by the borrower that enabled the lender to make a lending decision is fraudulent, incorrect or misleading.
  • Where the purchase price and borrowers direct contribution differ to details on the mortgage application form completed by the borrower
I currently have a mortgage with with April Mortgages. Conveyancing was finalised months ago. Should I wish to rent out the flat and do not currently have a buy-to-let mortgage do I need to remortgage to a buy-to-let mortgage or inform April Mortgages?
April Mortgages must be informed of your intention prior to renting your property as this is likely to be a breach of April Mortgages’s mortgage conditions. In many cases banks or building societies will permit you to let out your former home without needing to switch to a buy-to-let mortgage but some lenders will add a surcharge to your mortgage rate to reflect the higher risk. You should contact April Mortgages directly. You need not do this via a April Mortgages conveyancing panel solicitor.
