My IFA says he needs my Miskin law firm’s panel member for the Santander conveyancing panel. Can you suggest how I obtain this. I have tried my local Miskin branch but they cant find it on their system.
Have you tried contacting your Miskin property lawyer about this?. They maintain a central record lender panel numbers.
My grandmother passed away 10 months ago and as sole heir and executor I was left the house in Miskin. The house had a small mortgage left on it of around £8000. I want to have the title changed into my name whilst I re-mortgage to HSBC, pay off the mortgage. Is this possible?
Where you plan to refinance then HSBC will require that you use a conveyancer on the HSBC conveyancing panel. Here is link to the Land Registry online guidance around what to do when a property owner dies. This will help you to understand the registration process behind changing the details re the registered title. in your case it would appear that you are effectively purchasing the property from the estate. Your HSBC conveyancing panel solicitor pays the new mortgage money into the estate, the estate pays off the old mortgage, the charge is released and you become the owner and the HSBC mortgage is registered as a charge at the Land Registry.
Various web forums that I have come across warn that are the main reason for hinderance in Miskin conveyancing transactions. Is that correct?
The Council of Property Search Organisations (CoPSO) published determinations of a review by MoveWithUs that conveyancing searches do not feature within the common causes of hindrances in the conveyancing process. Searches are not likely to be the root cause of holding up conveyancing in Miskin.
I have been on the look out for a flat up to £305k and found one close by in Miskin I like with a park and railway links in the vicinity, the downside is that it's only got 49 years on the lease. There is not much else in Miskin suitable, so just wondered if I would be making a mistake purchasing a short lease?
If you require a home loan that many years may be a potential deal breaker. Reduce the offer by the amount the lease extension will cost if it has not already been discounted. If the existing owner has owned the premises for at least twenty four months you can request that they start the process of the extension and then assign it to you. An additional ninety years can be extended on to the current lease and have £0 ground rent by law. You should consult your conveyancing lawyer about this matter.
We're FTB’s - agreed a price, but the selling agent has warned us that the owners will only move forward if we appoint their chosen conveyancers as they are insisting on an ‘expedited deal’. My instinct tells me that we should use a high street conveyancer used to conveyancing in Miskin
It is unlikely the owners are driving this. Should the owner desire ‘a quick sale', alienating a motivated buyer is counter productive. Bypass the agents and go straight to the sellers and make the point that (a)you are serious buyers (b)you are ready to go, with finances arranged © you do not need to sell (d) you intend to proceed fast (e)but you intend to appoint your own, trusted Miskin conveyancing solicitors - as opposed tothe ones that will provide the estate agent a commission or meet his conveyancing figures set by corporate headquarters.
