My fiance and I decided to purchase a purpose built flat in Llanfyllin with a homeloan from Barnsley Building Society.We use our Llanfyllin conveyancing lawyer but Barnsley Building Society informed us he's not on their approved list of firms. we are left little option but to use a Barnsley Building Society panel firm or keep our preferred solicitor and pay for a Barnsley Building Society panel lawyer to represent them. This seems very unfair; Can we not simply insist that Barnsley Building Society use our lawyer?
No, not really. The loan issued to you is subject to its terms and conditions, one of which will be that solicitors will be on the Barnsley Building Society solicitor panel. Until recently, most lenders had large numbers of law firms on their panels: a borrower could find one for themselves, as long as it was on the lender's panel. The lender would then simply instruct the borrower's lawyers to act for the lender, too. You can use your lender's panel lawyers or you could borrow from another lender which does not restrict your choice. A further alternative is for your solicitors to apply to be on the conveyancing panel for Barnsley Building Society
My partner and I have arranged the release of further monies on our home loan from Lloyds as we want to carry out improvements to our home in Llanfyllin. Are we obliged to choose a high street Llanfyllin solicitor on the Lloyds conveyancing panel to deal with the legals?
Lloyds don't usually require firms on their approved list of lawyers to deal with the formalities. If they do require any legal work then you would need to ensure that such a lawyer was on the Lloyds panel.
We expect to receive a AIP from Nationwide this week so we can work out what to offer on a property we like as otherwise we are dependent on web based calculators (which aren't taking into account credit checks etc). You will need to appoint Llanfyllin solicitors independently although you'll need to choose one on the Nationwide conveyancing panel. The solicitor represents both you and Nationwide through the process.

Unless your lawyer obtains specific confirmation in writing that the mortgage company will go ahead, your lawyer has no choice but to refrain from exchanging contract and committing you to the purchase. We would suggest that you ask the lender to contact your lawyer in writing confirming that they will accept the number of years left on the lease.
